Involuntary Exclusions 2018
BEXAR-MEDINA-ATASCOSA COUNTIES WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1
ORDER SETTING PUBLIC HEARING TO EXCLUDE CERTAIN PROPERTY
Whereas, the board of directors of the Bexar-Medina-Atascosa Counties Water Control and Improvement District No. 1(the “BMA”) is authorized, by Texas Special District and Local Laws Code, chapter 9007, subchapter D to exclude land if certain conditions are satisfied, to wit:
- the property is not irrigable with water purchased from BMA because:
(a) BMA cannot deliver water by gravity flow to a high point on the property to irrigate the property; or
(b) the property has been subdivided into a tract of less than ten acres; or
(c) the property is part of a tract of land that has been subdivided into town lots, town lots and blocks, or similar small parcels of any size that will not be used for agricultural purposes or are suitable for a residential, a commercial, or nonagricultural purpose; or
- the property has not been irrigated with water purchased from BMA for a period of not less than three years before the date the notice of the exclusion hearing is mailed;
Whereas, the board of directors finds that it is in BMA’s best interest to exclude property if the property has not irrigated with water purchased from BMA for a successive period of five calendar years prior to the date this order is adopted;
Whereas, the board of directors finds that the property listed on the attached schedule has not been irrigated with water purchased from BMA for a successive period of at least five years;
Now, therefore, be resolved and ordered by the board of directors as follows:
- That the board of directors will hold a hearing to determine whether to exclude the property listed on the attached schedule during the regular meeting to be held on August 13, 2018, beginning at 5:00 p.m., at the BMA office in Natalia, Texas.
- A landowner may appear at the hearing and offer evidence to contest the exclusion by showing that the tract should not have been listed on the attached schedule.
- BMA staff is authorized and directed to mail notice of the hearing to the owners of the property listed on the attached schedule and to publish notice of the public hearing as required by law.
- Exclusion of the property does not affect or interfere with any rights that the BMA has to maintain and continue operation of any easements, canals, ditches, pipelines, pumps, or other facilities of the BMA that are located on the excluded property for the purpose of servicing property remaining in the BMA’s boundaries in accordance with applicable law.
- Pursuant to applicable law, property excluded property is not within the BMA and is not entitled to purchase water or receive any other service from BMA; assessments or other charges on the excluded property that are owed to BMA at the time the order of exclusion takes effect remain the obligation of the owner of the excluded property and continue to be secured by statutory liens on the property; and after the property is excluded, the owner has no further liability to BMA for future assessments or other charges based upon that property.

ORDEN POR LA AUDIENCIA PÚBLICA PARA EXCLUIR
CIERTOS PROPIEDADS
Considerando que, el consejo de administración de la Bexar-Medina-Atascosa Condados Control de Agua y Mejoramiento del Distrito No. 1 (el “BMA”) está autorizado, por el Texas Distrito Especial y Local Leyes Código, el capítulo 9007, subcapítulo D para excluir la tierra si cierta condiciones se cumplen, a saber:
- la propiedad noesde regadíocon aguacomprada aBMAporque:
- BMAno puede entregarel aguapor gravedada un puntoaltoen la propiedadpara el riego dela propiedad; o
- la propiedadse ha subdividido enun tramo demenos dediezhectáreas; o
- la propiedad esparte de unazona de la tierraque se hasubdividido enporciones de la ciudad, porciones de la ciudady los bloques, o pequeñas parcelassimilares de cualquiertamaño que noserán utilizadoscon finesagrícolas oson adecuadospara unresidencial, comercial,o propósitono agrícola; o
- la propiedad nose haregadocon aguacomprada aBMApor un período deno menos de tresaños antes de lafecha delanotificación de la audienciade exclusiónse envía por correo;
Considerando que, el Consejo de Administración considera que es en el mejor interés de BMA para excluir la propiedad si la propiedad no se ha regado con agua comprada a BMA por un período sucesivo de cinco años naturales anteriores a la fecha de esta orden se adopta;
Considerando que, el Consejo de Administración considera que la propiedad encuentre en el programa adjunto no ha sido regada con agua comprada a BMA por un período sucesivo de cinco años como mínimo;
Ahora, por lo tanto, resolver y ordenado por la junta directiva de la siguiente manera:
- Que el Consejo de Administración celebrará una audiencia para determinar si se excluye la propiedad que aparece en el calendario adjunto durante la reunión ordinaria que se celebrará el 13 de agosto de 2018, comenzando a las 5:00 pm, en la oficina de BMA en Natalia, Texas.
- Un terrateniente puede aparecer en la audiencia y ofrecer pruebas para impugnar la exclusión al mostrar que el aparato no debería haber sido incluido en el calendario adjunto.
- El personal de BMA se autoriza y ordena enviar por correo la notificación de la audiencia a los propietarios de los bienes que figuran en el calendario adjunto y publicar la notificación de la audiencia pública como lo requiere la ley.
- Exclusión dela propiedadno afecta niinterfiere conlos derechos quela BMAtiene paramantener ycontinuar la operacióndecualquier servidumbre, canales, acequias,tuberías,bombas,u otras instalacionesdela BMAque se encuentranen la propiedadexcluidospara lapropósito dedar serviciopropiedadqueda enlos límites de laBMAde conformidadcon la ley aplicable.
- De conformidad con lalegislación aplicable, los bienes excluidospropiedad noestá dentro de laBMA yno tiene derecho acomprar aguao recibircualquier otro serviciodeBMA; evaluacionesu otros gravámenessobrela propiedadexcluidosque se adeudan aBMAen el momentode laorden deexclusiónentra en vigorsiguen siendo laobligación delpropietario del inmuebleexcluidos ysiguenestaría garantizado por hipotecaslegales a lapropiedad;y después dela propiedadse excluye, el propietario tiene ninguna otra responsabilidadaBMApara futuras evaluacionesu otros cargossobre la base deesa propiedad.
