Notice of Adoption of Rules and Penalties:
This notice is issued by the Bexar-Medina-Atascosa Counties Water Control and Improvement District (the “BMA”) pursuant to Texas Water Code, section 51.129. BMA revised its policies, rules, and regulations regarding encroachments upon BMA property, including but not limited to roadway and utility crossing across BMA canals, and regarding the ordering, delivery, and use of water. The purpose of the rules, as revised, is to prohibit unauthorized use of BMA property located downstream of Diversion Lake, prohibit modification or damage to BMA property, impose requirements relating to the division of property served or to be served by the BMA or to be accessed by use of BMA property, adopting fees, charges, and penalties, and addressing other matters relating to the BMA canals and pipelines and the delivery of water. A breach of the policies, rules, and regulations subjects the violator to penalties, including, but not limited to, civil penalties up to the maximum amount allowed by law. The full text of the policies, rules, and regulations are on file in the BMA’s office and posted on BMA’s website where the policies, rules, and regulations may be read by any interested person.
